These Terms govern your access to and use of OrganicTrails (the "Service"), operated by Organic Trails ("we", "us"). By using the Service or purchasing any product, you agree to these Terms.
1. The Service
OrganicTrails sells KML files describing GPS routes for hiking, biking, and other adventure-tourism activities, alongside the related metadata shown on the site.
2. Acceptable use
You agree not to:
- use the Service for any unlawful purpose;
- engage in fraud, spamming, scraping, or attempts to interfere with the security or integrity of the Service;
- infringe our intellectual property rights or those of any third party;
- resell or redistribute the KML files or other content without our written permission.
3. Intellectual property
All software, documentation, trademarks, descriptions, maps, and KML files made available through the Service are owned by Organic Trails or our licensors. Purchasing a KML grants you a limited, non-exclusive, non-transferable licence for personal, non-commercial use.
4. Service level
We do not guarantee that the Service or any download will be uninterrupted or error-free. Conditions in the field can change; GPS data is provided as-is, without warranty for safety, navigation accuracy, or fitness for any particular activity.
5. Payments
Payments are processed by Stripe. Card data is collected and handled directly by Stripe under Stripe's End-User Terms. Organic Trails remains the seller of record for the KML files and is responsible for customer service and refunds.
6. Refunds
Refund requests are handled per our Refund Policy.
7. Suspension and termination
We may suspend or terminate your access for: material breach of these Terms, non-payment, suspected fraud or security risk, or repeated policy violations.
8. Liability
To the fullest extent permitted by law, our aggregate liability is limited to the amount you paid us in the 12 months preceding the event giving rise to the claim. We exclude liability for indirect, consequential, or special damages, including loss of profits, data, or goodwill.
9. Governing law
These Terms are governed by the laws of Brasil — São Paulo.
